Locally Best Platform
Locally Best provides online ordering services by entering into contractual arrangements with restaurant partners (“Restaurant Partners”) and Stores (as defined below) on a principal-to-principal basis for the purpose of listing their menu items or the Products (as defined below) for online ordering by the Customers on the Locally Best Platform.
The Customers can access the menu items or Products listed on the Locally Best Platform and place online orders against the Restaurant Partner(s)/Store(s) through Locally Best.
Before you can place orders for Items using our Application, you need to open a Locally Best account. When you open an account you may create a password, or other secure login method, and may also have to provide credit card details. You must keep any password you create, or other secure login method, secret, and prevent others from accessing your email account or mobile phone. If another person uses these methods to access your account, you will be responsible to pay for any Items they order, and we are not responsible for any other losses you suffer, unless the person using your password obtained it because we did not keep it secure.
Each Partner has a prescribed delivery area. This delivery area may change at any time due to factors such as weather, or demand on our service. This is to ensure that Items reach your door at their best. Our Partners each decide their own operating hours. That means that the availability of our Service, and the range of Partners from which you can order, depends on the Partners in your area. If you try to order a delivery to a location outside the delivery area or operating hours of a Partner, or the Application is otherwise unavailable for any reason, we will notify you that ordering will not be possible.
Your request to order food and beverages or Products from a Restaurant Partner or a Store page on the Locally Best Platform shall constitute an unconditional and irrevocable authorization issued in favour of Locally Best to place online orders for food and beverages or Products against the Restaurant Partner(s)/Store(s) on your behalf.
Delivery of an order placed by you through the Locally Best Platform may either be undertaken directly by the Restaurant Partner or the Store against whom you have placed an order, or facilitated by Locally Best through third-party who may be available to provide delivery services to you (“Delivery Partners”). In both these cases, Locally Best is merely acting as an intermediary between you and the Delivery Partners, or you and the Restaurant Partner or the Store, as the case may be.
The acceptance by a Delivery Partner of undertaking delivery of your order shall constitute a contract of service under the Consumer Protection Act, 2015 or any successor legislations, between you and the Delivery Partner, to which Locally Best is not a party under any applicable law. It is clarified that Locally Best does not provide any delivery or logistics services and only enables the delivery of food and beverages or Products ordered by the Customers through the Locally Best Platform by connecting the Customers with the Delivery Partners or the Restaurant Partners or the Store, as the case may be.
Where Locally Best is facilitating delivery of an order placed by you, Locally Best shall not be liable for any acts or omissions on part of the Delivery Partner including deficiency in service, wrong delivery of order, time taken to deliver the order, order package tampering, etc.
You may be charged a delivery fee for delivery of your order by the Delivery Partner or the Restaurant Partner or the Store, as the Delivery Partner or the Restaurant Partner or the Store may determine (“Delivery Charges"). You agree that Locally Best is authorized to collect, on behalf of the Restaurant Partner or the Delivery Partner or the Store, the Delivery Charges for the delivery service provided by the Restaurant Partner or the Store or the Delivery Partner, as the case may be. The Delivery Charges may vary from order to order, which may be determined on multiple factors which shall include but not be limited to Restaurant Partner / Store, order value, distance, time of the day. Locally Best will inform you of the Delivery Charges that may apply to you, provided you will be responsible for Delivery Charges incurred for your order regardless of your awareness of such Delivery Charges.
In addition to the Delivery Charges, you may also be charged an amount towards delivery surge for delivery of your order facilitated by the Delivery Partner or the Restaurant Partner or the Store, which is determined on the basis of various factors including but not limited to distance covered, time taken, demand for delivery, real time analysis of traffic and weather conditions, seasonal peaks or such other parameters as may be determined from time to time (“Delivery Surge"). You agree that Locally Best is authorized to collect, on behalf of the Restaurant Partner or the Delivery Partner or the Store, the Delivery Surge for the delivery service provided by the Restaurant Partner or the Store or the Delivery Partner, as the case may be.
The Delivery Surge may vary from order to order, which may be determined on multiple factors which shall include but not be limited to Restaurant Partner / Store, order value, distance, demand during peak hours. Locally Best will use reasonable efforts to inform you of the Delivery Surge that may apply to you, provided you will be responsible for Delivery Surge incurred for your order regardless of your awareness of such Delivery Surge.
Age Restricted Products
Age restricted products (including, without limitation, alcohol, tobacco and cigarettes) can only be sold and delivered to persons aged 18 or over. By placing an order for an age restricted product, you confirm that you are at least 18 years old. Locally Best operates an age verification policy whereby customers ordering age restricted products will be asked by the rider to provide proof that they are aged 18 or over before the delivery is completed. The rider may refuse to deliver any age restricted product to any person unless they can provide valid photo ID proving that they are aged 18 or over. The Partner and the rider may refuse to deliver alcohol to any person who is, or appears to be under the influence of either alcohol or drugs. If delivery of any age restricted product is refused, you will still be charged for the relevant Item and for delivery.
When you place an order, you will have the option to pay a tip to your rider or the Partner, in addition to the purchase price of the Items in your order. Any payment will be collected by Locally Best using the payment method used for the original order and your rider or the Partner will receive 100% of any payment you choose to make.
When you place a Pick-up Order through our Application, it needs to be accepted by us or the Partner Restaurant / Stores before it is confirmed. Your Pick-up Order may be rejected at any time. Our Partner Restaurants/Sotres may, for example, reject your Pick-up Order if they are too busy or the Items you have ordered are temporarily unavailable.
We will send you a notification if your Pick-up Order has been accepted (the "Confirmation Notice"). The contract for the supply of any Item you have ordered comes into existence when we send the Confirmation Notice. You are responsible for paying for all Items ordered using your account and for complying with these Terms, even if you have ordered the Item for someone else. Some Partner Restaurants operate a minimum order value policy. This will be displayed on our Application. All Items are subject to availability.
Partner Restaurants/ Sotres may use nuts or other allergens in the preparation of certain Items. Increasing numbers of Partner Restaurants will be displaying dish by dish allergens information. Where that information is not available or if you have further questions, please contact the restaurant prior to ordering if you have an allergy. Locally Best cannot guarantee that any of the Items sold by our Partner Restaurants/ Stores are free of allergens.
When you place a Pick-up Order which is accepted by the Partner Restaurant/Stores, the Partner Restaurant/Stores will tell you the time when your Items are expected to be ready for pick-up (“Pick-up Time”). The Pick-up Time is not guaranteed by either us or our Partner Restaurants/Sotres. You will be required to collect your Items directly from the Partner Restaurant/Sotre at the Pick-up Location. You must arrive at the Partner Restaurant to collect your Items at or just before the Pick-up Time. Our Partner Restaurants will hold your Items for you for 30-60 minutes after the Pick-up Time. If you fail to collect your Items within 30-60 minutes after the Pick-up Time, the Partner Restaurant/ Sotre may dispose of your Items. You will still be charged for the Item in the event you fail to pick-up your Item from the Partner Restaurant.
